🔸The Executive Impact of the Unified Lease Contract on the Rental Real Estate Sector

The Ministry of Housing has launched the Unified Lease Contract, which aims to document lease agreements and protect the rights of landlords, tenants, and real estate brokers. This contract is considered an enforceable executive document, binding and executable before judicial and enforcement authorities. Undoubtedly, having this contract with such a feature contributes to organizing the rental real estate sector and reducing disputes before judicial and enforcement bodies. Cabinet Resolution No. (292) dated 16/5/1438H stipulated that any lease contract not registered in the “Ejar Electronic Network” is not considered a valid contract producing administrative or judicial effects. This means that the enforcement authority will not consider any lease contract signed directly by the landlord and tenant, or through a real estate broker, except for the Unified Lease Contract. Additionally, real estate brokers are obligated to register all residential and commercial lease contracts through the electronic network (Ejar Electronic Network) according to Cabinet Resolution No. (405) dated 22/9/1437H. The contract is concluded through a licensed real estate broker, who acts similarly to a notary for the Unified Lease Contract. A contract executed through the Ejar Network is considered notarized in terms of evidence and enforcement under Cabinet Resolution No. (131) dated 3/4/1435H, making it an executive instrument. Accordingly, under the Enforcement Law, the landlord (creditor) can approach the execution judge directly to enforce payment from the tenant (debtor) if the rent is overdue. The execution judge has the authority to compel enforcement; if the tenant delays or fails to disclose sufficient assets to settle the debt within five days of being notified of the execution order, the judge may prevent the tenant from traveling, imprison them until the debt is recovered, or seize the tenant’s assets, including real estate, financial, commercial, or any other assets, for sale to satisfy the landlord’s claim. All the tenant’s assets are considered a guarantee for their debts, and the tenant cannot dispose of these assets once the execution judge orders a seizure. The judge may also prevent government entities or financial institutions from dealing with the tenant. However, seizure and enforcement cannot target the tenant’s residence, means of transport, personal belongings, tools required for their profession, or wages and salaries except for one-third of the total salary. Cabinet decisions also consider cases where the tenant cannot pay rent. Cabinet Resolution No. (405) dated 22/9/1437H established that the Minister of Housing may form one or more committees from relevant authorities to handle cases where a Saudi tenant is unable to pay rent or vacate the property, whether due to imprisonment, illness, death, or financial inability. The committee must decide within thirty days from the execution judge’s notification regarding payment, provision of suitable housing, or accommodation support for the tenant. The Unified Lease Contract obligates the landlord to cover necessary routine maintenance to preserve the leased unit and to repair any defects affecting the tenant’s use of the unit. The tenant has the right to enforce compliance if the landlord fails to fulfill these obligations. The landlord is also responsible for any service fees imposed on the leased units by the relevant authority. The new owner may not evict the tenant until the contract term ends. The contract further stipulates that the landlord may request eviction if the tenant delays rent payment, in whole or in part, for more than thirty (30) days after notice unless the parties agree otherwise in writing. Finally, there is no doubt that the Unified Lease Contract clearly contributes to organizing the rental real estate sector by activating real estate brokers and protecting the rights of landlords and tenants. The contract serves as an executive instrument and details the rights and obligations of both parties.
